Terms of Service
Last updated 4 October 2026. This page is information, not legal advice.
1. Introduction and parties
These Terms of Service (the "Terms") govern use of Graidable (the "Service"), provided by Lukas Thrane (sole proprietorship), reg. no. 936 043 925, Vegamot 1N, 7049 Trondheim, Norway (the "Provider", "we", "us"). The Service is used by educational institutions, teachers, teaching assistants and other authorised users (the "Customer", "you"). By creating an account or using the Service you accept these Terms. If you act on behalf of an institution, you confirm you are authorised to do so.
2. Description of the Service
Graidable uses optical character recognition ("OCR") and artificial intelligence ("AI") to read students' work (typed or handwritten, in any subject), sort it to the students on your class list, draft the questions, criteria and answer key from your files, and generate draft assessments and feedback. Outputs are suggestions, not final grades or decisions. The human user must always review, correct and approve the output and makes any final decision. The Service must not be used for fully automated grading or decisions producing legal effects on students without human review.
3. Accounts, access and eligibility
You are responsible for keeping credentials confidential and for all activity on your account, and for ensuring that teaching assistants and other delegated users are granted access only to the extent necessary for the task.
4. Customer responsibilities
The Customer is the data controller for personal data uploaded to the Service and is responsible for: having a valid legal basis under the GDPR; informing students (and guardians of minors where relevant) that AI-assisted assessment is used; uploading only data it is entitled to process and practising data minimisation (for example using candidate labels or numbers in place of names where feasible); and not using the Service unlawfully or to infringe third-party rights. Processing on the Customer's behalf is governed by the Data Processing Agreement (DPA), which you accept with these Terms. In case of conflict, the DPA prevails on matters of data protection. See our Privacy Policy and DPIA.
5. AI limitations and human oversight
AI outputs may contain errors, inaccuracies or bias, including sorting a page to the wrong student. Output must be treated as a draft requiring human review; the Provider does not warrant that assessments are accurate, complete or fit for a particular purpose; and responsibility for final assessment and grading rests with the Customer. AI used to evaluate learning outcomes may be regulated as "high-risk" under the EU AI Act; the Customer is responsible for its own compliance as deployer.
6. Sub-processors and data storage
The Service uses third-party sub-processors for hosting, storage, reading (OCR), email, AI processing and payments. Storage, the database, email and reading run in the EU/EEA. Every AI request passes through OpenRouter in the USA, and the model that sorts work to students (TypeSafe, USA) receives students' names and the text of their work. The full list, with what each receives, its location and the transfer mechanism, is in the Privacy Policy and the DPA. Content is not used to train AI models.
7. Intellectual property
The Provider retains all rights to the Service, software and underlying models. The Customer retains all rights to its own content and grants the Provider a limited, time-bound licence to process it solely to deliver the Service.
8. Plans, prices and payment
Current prices, the gradings each plan includes and the rates for extra gradings are on the pricing page, in US dollars. What you agree to at checkout applies.
What counts as a grading. One student graded with AI is one grading. Grading a student again counts again. A grading that fails or is cancelled is not counted. Setting up an assignment, reading and sorting the work, and reviewing the results are not gradings.
Without a plan. You can use the Service without a plan within a small free allowance, counted in total and not per month: 60 pages read and 12 files of student work. A file counts until it is erased. Grading with AI needs a plan.
Sample classes. Adding a sample class is free. It comes already read and graded, no AI is called, and it counts neither toward the free allowance nor as gradings. Your own uploads into a sample class, and grading with AI there, count as usual.
Plans. There are two plans, Student and Professional, each paid monthly or once a year. Each billing period includes a number of gradings: a month's on a monthly plan, a year's on an annual plan. Unused gradings do not carry over to the next period. You pay in advance for each period, by card through Stripe. A plan renews automatically at the end of each period until you cancel it.
Free gradings and the card. You add a card when you choose your first plan, and pay for its first period at checkout. The first plan on an account starts with 10 free gradings, which are used before the plan's included gradings during its first billing period only. They apply once per account.
Extra gradings. When a period's gradings are used up, grading with AI stops until the next period starts, unless you turn on extra gradings in your billing settings. Extra gradings are off until you turn them on. When they are on, each extra grading is charged at your plan's rate and billed on your next invoice.
Changing plans. You can switch plans, or switch between monthly and annual billing, at any time. The change applies at once and the price is prorated.
Cancelling. You can cancel your plan in your billing settings. It then runs to the end of the period you have paid for and ends; the rest of that period is not refunded, and you can undo the cancellation before it ends. Once you have cancelled a plan, a later plan does not start with free gradings.
Refund in the first period. If you cancel your first plan during its first billing period, and have used no gradings beyond the free ones, the plan ends at once and we refund that period's payment in full.
Deleting your account ends your plan at once. The rest of the period is not refunded.
Pilots and schools. Pilots and prices for several teachers or a whole school are agreed in writing. During an agreed pilot, grading with AI is not charged. When the pilot ends, grading with AI needs a plan; your data stays until you delete it.
9. Disclaimers and limitation of liability
The Service is provided "as is". To the extent permitted by law, the Provider disclaims all warranties not expressly stated and is not liable for indirect losses or for assessment decisions made by the Customer. Aggregate liability is limited to NOK 10,000, except for liability that cannot be excluded under mandatory law.
10. Term and termination
The agreement continues until your account is deleted or either party terminates it. You can delete your account at any time in Account settings; your data is then erased as described in the Privacy Policy. When a plan ends, your account and data stay. On termination the Provider deletes the Customer's personal data per the DPA unless retention is legally required. The Customer may request deletion at any time.
11. Changes, governing law and contact
The Provider may update these Terms; material changes are notified with reasonable notice. The Terms are governed by Norwegian law, with venue Trøndelag District Court (Trondheim). Contact: Lukas Thrane (Graidable), [email protected].
