Terms of Service

1. Introduction and parties
These Terms of Service (the "Terms") govern use of Graidable (the "Service"), provided by Lukas Thrane (sole proprietorship), reg. no. 936 043 925, Vegamot 1N, 7049 Trondheim, Norway (the "Provider", "we", "us"). The Service is used by educational institutions, teachers, teaching assistants and other authorised users (the "Customer", "you"). By creating an account or using the Service you accept these Terms. If you act on behalf of an institution, you confirm you are authorised to do so.
2. Description of the Service
Graidable uses artificial intelligence ("AI") and optical character recognition ("OCR") to analyse submissions (essays, programming assignments and handwritten STEM exams) and generate draft assessments and feedback. Outputs are suggestions, not final grades or decisions. The human user must always review, correct and approve the output and makes any final decision. The Service must not be used for fully automated grading or decisions producing legal effects on students without human review.
3. Accounts, access and eligibility
You are responsible for keeping credentials confidential and for all activity on your account, and for ensuring that teaching assistants and other delegated users are granted access only to the extent necessary for the task.
4. Customer responsibilities
The Customer is the data controller for personal data uploaded to the Service and is responsible for: having a valid legal basis under the GDPR; informing students (and guardians of minors where relevant) that AI-assisted assessment is used; uploading only data it is entitled to process and practising data minimisation (e.g. de-identifying submissions where feasible); and not using the Service unlawfully or to infringe third-party rights. Processing on the Customer's behalf is governed by a separate Data Processing Agreement (DPA). In case of conflict, the DPA prevails on matters of data protection. See our Privacy Policy and DPIA.
5. AI limitations and human oversight
AI outputs may contain errors, inaccuracies or bias. Output must be treated as a draft requiring human review; the Provider does not warrant that assessments are accurate, complete or fit for a particular purpose; and responsibility for final assessment and grading rests with the Customer. AI used to evaluate learning outcomes may be regulated as "high-risk" under the EU AI Act; the Customer is responsible for its own compliance as deployer.
6. Sub-processors and data storage
The Service uses third-party sub-processors for storage, OCR, email and AI processing. A current list, with location and transfer mechanism, is in the Privacy Policy and DPA. Where agreed, data is processed and stored within the EU/EEA. Content is not used to train AI models.
7. Intellectual property
The Provider retains all rights to the Service, software and underlying models. The Customer retains all rights to its own content and grants the Provider a limited, time-bound licence to process it solely to deliver the Service.
8. Fees and pilot
Unless otherwise agreed in writing, pilot use is provided free of charge for an agreed period. Further or commercial use is governed by a separate agreement.
9. Disclaimers and limitation of liability
The Service is provided "as is". To the extent permitted by law, the Provider disclaims all warranties not expressly stated and is not liable for indirect losses or for assessment decisions made by the Customer. Aggregate liability is limited to NOK 10,000, except for liability that cannot be excluded under mandatory law.
10. Term and termination
The agreement continues until terminated by either party. On termination the Provider deletes the Customer's personal data per the DPA unless retention is legally required. The Customer may request deletion of pilot data at any time.
11. Changes, governing law and contact
The Provider may update these Terms; material changes are notified with reasonable notice. The Terms are governed by Norwegian law, with venue Trøndelag District Court (Trondheim). Contact: Lukas Thrane (Graidable), [email protected].
